Michigan's Offender Tracking Information System, OTIS, tracks state prisoners, parolees, and MDOC-supervised probationers. If a Charlevoix County resident was sentenced to a state facility, their record would appear in OTIS, not the county jail system.

FOIA Requests to Charlevoix County Sheriff

Michigan's Freedom of Information Act, at MCL 15.231, gives you the right to request public records from the Charlevoix County Sheriff's Office. Booking records, incident reports, and other law enforcement documents generally qualify as public records under this law.

Submit your request in writing. You can mail it, email it, or hand it in at the Sheriff's Office. Describe the record you want clearly enough that staff can find it. Fees may apply for staff time and copying. If you receive public assistance or can show financial hardship, you can request a fee waiver using an Affidavit of Indigency. Up to $20.00 of the processing fee can be waived, and this benefit is available up to twice per year. If parts of a record are exempt from release, the office should still give you the non-exempt portions with exempt sections redacted.

What Charlevoix County Booking Records Include

A booking release from the Charlevoix County Jail includes the person's full name, date of birth, booking date and time, and charges. A booking number is assigned at intake. The record shows current custody status, whether the person is still held, released, or transferred.

Bond or bail amounts appear on most booking records. This tells you whether a financial condition of release was set and at what amount. Physical description fields like height, weight, and gender may appear depending on what the Sheriff's Office publishes. Some details may be withheld if releasing them would compromise an active investigation or violate privacy protections under Michigan FOIA exemptions.

A booking record is not a conviction record. It documents that someone was taken into custody and processed at the jail. Charges can be dismissed, reduced, or result in acquittal after the booking is made. MCL 28.243 governs how law enforcement agencies report criminal history data to the Michigan State Police. This shapes what ends up in statewide databases, but the booking record itself is created and held by the Sheriff's Office.

Full felony and serious misdemeanor conviction records are available through ICHAT, the Michigan State Police criminal history database. ICHAT covers all 83 counties but does not include county jail booking records directly.
